By using our app.amberscript.com website you are indicating that you agree to our terms and conditions.<\/p>\n<h3>Our platform and our services<\/h3>\n<p>Amberscript has developed the Amberscript platform using AI technology to provide transcription, captioning and subtitling services. We use automated speech-to-text algorithms to generate accurate transcripts\/captions and an optional service to have texts perfected by our transcribers. Our website is maintained to provide the following services (referred to hereafter as services):<\/p>\n<ul>\n<li>Uploading of audio\/video files to our website.<\/li>\n<li>Automatically creating transcripts\/captions of the audio\/video files.<\/li>\n<li>Linking the transcript to the relevant audio\/video content.<\/li>\n<li>Our online editor on app.amberscript.com allows you to easily edit the relevant transcript.<\/li>\n<li>Access to manual transcription services performed by a large network of qualified transcribers.<\/li>\n<li>Access to manual caption\/subtitling services performed by a large network of qualified subtitlers.<\/li>\n<li>A variety of ways to export and share the content.<\/li>\n<\/ul>\n<p>Amberscript reserves the right to revise these terms from time to time. Users of Amberscript are advised to review the current terms of use, as the latest version is binding.<\/p>\n<h3>Free Trial, Fees &amp; Subscriptions: Automatic Transcription\/Caption<\/h3>\n<p>Amberscript offers new clients a free trial for automatic transcription\/caption. If you are a new user signing up to the Amberscript Platform for the first time, you will have 00:10:00 minutes of credits added to your account. Your account also includes a demo video explaining our tool.<\/p>\n<p>These credits can be used for automatic transcriptions\/captions for an audio\/video file that is not longer than the minutes of credits in your account (i.e. the 00:10:00 minutes). You do not need to enter your payment details in order to enjoy the free trial. Note that once you surpass the 00:10:00 minutes of credits, the platform will request your payment details.<\/p>\n<p>When your free trial for automatic transcription\/captioning ends, you can choose one of the following options:<\/p>\n<ul>\n<li><strong>Automatic Per Hour:<\/strong> You buy credits per hour (i.e. 00:60:00 minutes of credit) which will be directly added to your account. This allows you to upload audio\/video files into the Amberscript Platform until you\u2019ve used all credits purchased. Credits in your account are valid for 12 months from the day of purchase. Unused credits will not be refunded.<\/li>\n<li><strong>Automatic Yearly and Monthly Subscriptions:<\/strong>When you sign up for our automatic annual or monthly subscription, a one-time payment for sixty (60) hours or a monthly payment for five (5) hours of credit will be set up immediately. On the same day of the following month, the subscription date, the next payment for the monthly subscription will be processed (i.e., if you sign up on May 15, the second payment will be processed on June 15). If you do not use the five (5) hours of credit in a given month, they will not be carried over to the next month in your account. If you use more than the five (5) hours of credit in a given month, you can continue to upload files, but you will receive an additional invoice at the end of the month for the credit you used in excess of the five (5) hours. The minimum term for our automatic monthly subscription is two (2) months. After the minimum term, the subscriptions will automatically renew for the same period, unless cancelled before the end of the current term (month or year).<\/li>\n<\/ul>\n<p>All license fees payable by Licensee under this Agreement for use of the Amberscript Systems are subject to an increase of five percent (5%) per annum or the CPI, as published in the Wall Street Journal, whichever is greater<\/p>\n<p>An overview of all Amberscript services fees can be found <a href=\"https:\/\/wp-staging.amberscript.com\/en\/pricing\/\">here.<\/a><\/p>\n<h3>Duplicate Accounts<\/h3>\n<p>Each user is allowed to have one (1) active Amberscript account. Amberscript reserves the right to refuse the creation of duplicate accounts for the same user. In a case where duplicate accounts are detected, we have the right to inactivate these duplicate accounts without notification.<\/p>\n<h3>Fees &amp; Delivery Timelines: Manual Transcription\/Caption<\/h3>\n<p>Next to our automatic services, Amberscript offers a manual transcriptions\/captions service. This is performed by a large network of qualified transcribers and subtitlers, who correct the automatically generated transcript according to Amberscript\u2019s transcription guidelines and according to clean-read, clean-verbatim or verbatim transcription standards. Any special requirements for the transcription or captions should be shared at the latest when placing the order. If the requirements are not shared prior to the upload, the standard guidelines will apply. Our internal quality-control officers check the transcript before delivering it to the customer. For this service, you pay per transcribed\/subtitled minute.<\/p>\n<p>All license fees payable by Licensee under this Agreement for use of the Amberscript Systems are subject to an increase of five percent (5%) per annum or the CPI, as published in the Wall Street Journal, whichever is greater.<\/p>\n<p>Amberscript agrees to deliver the files within three (3) to five (5) business days* after the file is uploaded. Business days are Monday, Tuesday, Wednesday, Thursday, and Friday with the exception of Public Holidays. These delivery times are average values and based on experiences, individual cases may vary if the file is uploaded to the Amberscript platform before 16:00 CET, then Amberscript will consider it to be uploaded on that business day. In case a file is uploaded after 16:00 CET on a given day, the next business day is considered as the upload date (e.g. if a file is uploaded on Monday before 16:00 CET, the file will be ready no later than the following Monday 16:00 CET).<\/p>\n<p>When choosing &#8216;Payment via invoice&#8217;, an additional administrative fee of 5% will be added to your invoice. An overview of all Amberscript services fees can be found <a href=\"https:\/\/wp-staging.amberscript.com\/en\/pricing\/\">here.<\/a><\/p>\n<p>*Amberscript reserves the right to deviate from the delivery time in case a customer uploads more than ten (10) hours of audio\/video at once.<\/p>\n<h3>Refund Policy<\/h3>\n<p>To ensure that our customers are familiar with our product and its quality, we provide a 10-minute free trial of our software for automatic transcriptions\/captions. We, therefore, do not offer refunds based on the level of satisfaction with the quality of the end product. In case a technical error occurs, Amberscript will do everything it can to resolve the issue or compensate for any lost transcription time.<\/p>\n<p>In the case of an automatic monthly subscription, the minimum term of this subscription is two months. You will, therefore, even if you cancel your subscription after one month, always be billed for two months. Amberscript, therefore, cannot offer a refund for the second month in case you have unsubscribed in the first month, or in case that you forgot to cancel your subscription.<\/p>\n<p>For manual transcription\/caption, our transcribers will correct the automatically generated transcript according to Amberscript\u2019s transcription guidelines and according to clean-read, clean verbatim or verbatim transcription standards. Our internal quality-control officer checks the quality of the transcript before delivering it to the customer. Should you feel that a transcript does not meet the guaranteed accuracy rate, you can contact us no later than five (5) working days after receiving the transcript\/caption. A detailed explanation of the expected revision needs to be shared in order for Amberscript to enhance the quality. A revision of the transcript will be done within five (5) business days. In the rare case that the quality of a transcript will still not be met, Amberscript will decide on refunds on a case-by-case basis, after communication with the customer.<\/p>\n<p>Please note that the 99% accuracy guarantee holds true for good\/high audio quality, as good\/high audio quality is a key requirement for accurate transcriptions. For low audio quality files, the accuracy rate cannot be guaranteed. The quality of the audio is at the discretion of Amberscript.<\/p>\n<h3>Content on the website<\/h3>\n<p>All content on the Amberscript website is protected by copyright and other intellectual property rights. You are not allowed to copy or license any of the Amberscript website content without the written permission of Amberscript.<\/p>\n<h3>Service Agreement<\/h3>\n<ol>\n<li>Amberscript aims to be fully operational 24 hours a day. However, if for any reason the website is unavailable, the company is not liable.<\/li>\n<li>When registering for our services, customers must choose a password. Users are responsible for keeping their passwords confidential.<\/li>\n<li>Amberscript\u2019s customer service is available during business hours (09:00 &#8211; 18:00 CET) on weekdays (Monday to Friday) via telephone or email.<\/li>\n<\/ol>\n<p class=\"p-rich_text_section\">For our automatic transcription\/caption service, Amberscript shall deliver editable transcripts of the audio\/media files within two (2) hours 95% of the time. In case of the following rare events, Amberscript is not bound by the service agreement concerning editing time:<\/p>\n<ul class=\"p-rich_text_list p-rich_text_list__bullet\" data-stringify-type=\"unordered-list\" data-indent=\"0\" data-border=\"0\">\n<li data-stringify-indent=\"0\" data-stringify-border=\"0\">Scheduled downtime.<\/li>\n<li data-stringify-indent=\"0\" data-stringify-border=\"0\">Events outside reasonable control.<\/li>\n<\/ul>\n<p class=\"p-rich_text_section\">If Amberscript fails to meet the editing time and none of the rare circumstances are applicable, users will receive a voucher for automatic transcription of one (1) audio hour (i.e. 00:60:00 credits).<\/p>\n<p>Amberscript does not have any obligation of a result to its users. The quality of transcriptions is heavily dependent on the quality of the audio. Background noise(s), low-quality microphones, a low\/poor recording quality, strong accents, and e.g. people speaking simultaneously can all lower the transcription quality. Users themselves are responsible for testing the transcription quality in order to get an understanding of the expected results. Amberscript never gives refunds due to disappointing transcription quality. The quality of the audio is at the discretion of Amberscript.<\/p>\n<h3>Privacy Policy<\/h3>\n<p>Because Amberscript takes the privacy of its customers very seriously, it has put a number of measures in place to ensure that it is maintained. To find out more about how Amberscript protects your personal information, please view our privacy policy <a href=\"https:\/\/wp-staging.amberscript.com\/en\/privacy-policy\/\">here.<\/a><\/p>\n<h3>Your content<\/h3>\n<p>Users are not allowed to upload files of the following type:<\/p>\n<ul>\n<li>Files that contain another person\u2019s personal information without that person\u2019s written consent.<\/li>\n<li>Files that contain information that encourages conduct that may be deemed a criminal offense.<\/li>\n<li>Files that the user uploads without the right to use those files (e.g. copyrighted material).<\/li>\n<li>Files that are technically harmful to us or services from others.<\/li>\n<\/ul>\n<p>Amberscript reserves the right to not accept files or refuse to transcribe any submitted material that contravenes the terms that are listed above.<\/p>\n<h3>Fair Use Policy (FUP)<\/h3>\n<p>The Fair Use Policy (FUP) aims to prevent the unreasonable use of the machine translation service.<\/p>\n<p>Amberscript will deem your use of our machine translation service to be excessive and\/or unreasonable if it significantly exceeds the range of anticipated use patterns or is likely to harm or adversely affect how well it works.<\/p>\n<p>Amberscript reserve the right to restrict, suspend, or terminate your access to the machine translation service immediately and without justification if your excessive or unreasonable usage persists despite our requests to halt or change the nature of such usage.<\/p>\n<h3>Use of the Customer&#8217;s distinctive Signs as well as referencing the Customer<\/h3>\n<ul>\n<li>The Provider shall receive the non-transferable, geographically unlimited, non-exclusive right to use the brands, company name, and logos of the Customer and the Authorized Third Parties (hereinafter collectively referred to as &#8220;Signs&#8221;). This right of use to the Signs is limited to use in connection with performance of the contractual services under the Service Contracts and lasts until the end of the corresponding Service Contracts. When using the Signs, the Provider must comply with the Customer&#8217;s requirements.<\/li>\n<li>As long as the contractual relationship between the Provider and the Customer continues, the Provider is authorized to mention the Customer and the Authorized Third Parties as references (e.g., on the Provider&#8217;s website, on its advertising documents, etc.) and to use the Signs for this purpose. Documentation, documents, etc., that have already been printed need not be destroyed after the end of the contractual relationship.<\/li>\n<li>If a third party takes legal action against the Provider (or its Subcontractors) based on the use of the Signs by the Provider (or its Subcontractors), the Customer shall indemnify the Provider entirely from the third-party claims (including assuming costs of legal proceedings and reasonable representation costs).<\/li>\n<li>The Provider shall remove each Sign of the Customer from its Website and marketing documents in seven working days if the Customer will ask the Provider to do so in written form (by letter, e-mail, etc.).<\/li>\n<\/ul>\n<\/div>\n    <\/div>\n<\/div>\n\n\n<section class=\"w-full flex justify-center\">\n    <div class=\"flex flex-col max-w-container w-full px-4 lg:px-[100px] gap-title-description-spacing-mobile sm:gap-title-description-spacing-desktop py-block-padding-1-mobile xl:py-block-padding-1-desktop\">\n        <div class=\"flex flex-col p-6 w-full gap-title-description-spacing-mobile sm:gap-title-description-spacing-desktop bg-surface-elevated shadow-sm active:outline active:outline-1 active:outline-offset-4 active:outline-blue-500 rounded-lg overflow-hidden border-and-shadow\">\n            <h5 class=\"text-h5 text-content-primary !mt-0\">Disclaimer<\/h5>\n            <p class=\"text-body-2 text-content-secondary whitespace-pre-line\"><p class=\"p1\">Amberscript issues its General Terms and Conditions, Privacy Statement, and other legal documents in the English language for reasons of consistency.
